1031 Exchange is a process in which a seller of real estate wants to defer the payment of taxes which would otherwise be due upon selling property. Replacing a property that was sold with new acquired property is how this occurs. When the correct procedure is followed, the Internal Revenue Service will recognize the transaction, not as a sale and a purchase, but as an exchange of a relinquished property with a replacement property. This allows the seller to defer any taxable gain into a new real estate purchase.
